NYC Storefront Roll-Down Gate Law in 2026: The 70% See-Through Rule Is Gone

For years, NYC store owners heard that every solid roll-down gate had to be swapped for a see-through grille by July 1, 2026. That deadline came from Local Law 75 of 2009. If you were budgeting for a replacement, there’s good news: the requirement has been repealed.

What changed

On June 30, 2026, the City Council passed Intro 910-A (now Local Law 123 of 2026), which took effect immediately. It removed the rule that security grilles on business (Group B) and retail (Group M) buildings must leave at least 70% of the covered area visible, along with the July 1, 2026 deadline and the related penalties.

According to the NYC Department of Buildings:

  • Existing gates: You don’t have to replace a solid gate just because it isn’t 70% see-through.
  • Replacing a worn or damaged gate: You can choose the style that fits your needs. It doesn’t have to be a 70% visible grille.
  • First-time installs: A brand-new grille doesn’t have to meet the 70% rule either.

What still applies

The repeal didn’t remove every rule. DOB still says:

  • A new security grille (where none existed before) needs a DOB permit and has to be shown on plans.
  • A replacement doesn’t always need a permit, but one can be triggered if the work affects structural elements or the means of egress.
  • A motorized gate that runs on electricity also needs an electrical permit.

When you’re unsure, DOB recommends checking with a design professional before the work starts.

Solid gate or open grille: how to choose now

With the mandate gone, it’s a business decision again:

  • Solid slat gates block the view inside and give strong protection for stock and glass, but they can be graffiti magnets and make the block look closed after hours.
  • Open-link or perforated grilles let window displays stay visible at night and make it easier for passersby and patrol to see inside.
  • Either way, the lock, the slats, the bottom bar, and the motor or spring are where most problems start. A gate that sticks, drops unevenly, or won’t lock is a security problem whatever style it is.

Repair or replace?

Before you replace a whole gate, check whether the real issue is the lock, a bent bottom bar, worn slats, a weak spring, or a failing motor or key switch. Many of these can be fixed without a full replacement. If the gate is badly bent, rusted through, or the curtain keeps coming off track, replacement usually makes more sense.
